NQ Legal can take the pressure off your business by recovering your debts, so that your business can get paid sooner.

We find that most debtors tend to pay their debts once they get demand letters from us, as that is a clear indication to them that our clients are serious about enforcing their rights and it is generally enough to prevent further legal action. However, if necessary, we are prepared to take matters further and proceed with legal actions against debtors either through Courts or in some instances through the Queensland Civil and Administrative Tribunal (QCAT) on your behalf. Debts of up to $150,000.00, if necessary can be recovered in the Magistrates Court.

Debts over $150,000.00 (but under $750,000.00) must be recovered in the District Court, whilst debts over $750,000.00 must be recovered in the Supreme Court. Creditors may now commence recovery proceedings themselves for minor debts, through QCAT and NQ Legal can help you with this process as well. We can assist you with:

  • Preparing a letter of demand;
  • Starting proceeding in the Courts and the QCAT;
  • Obtaining Judgment against the debtor; and
  • Enforcing judgments against the debtors.

Once Judgment against a debtor is obtained there are a number of ways to enforce it. We can further assist you with Warrants for seizure and sale of debtors property, Enforcement Hearing Summons (requiring the debtor to attend Court to display how they will satisfy the Judgment), and Garnishees Orders (whereby the Court can order a third party to pay money to a creditor instead of a debtor). We can further assist you with commencing either bankruptcy proceedings for individuals or winding up proceedings against companies.
