Criminal Charges

NQ Legal | Solicitors | TownsvilleIf you are charged with a criminal offence and/or you are being questioned by the police regarding a criminal matter and/or you are facing real prospects of being charged with a criminal offence it is particularly important that you contact your solicitor before you provide any statements to the police. You have a right to have a solicitor present during questioning and not to give statements until you have been provided with a legal advice. In most instances you may be within your rights not to give statements at all.

Criminal charges are usually divided in two major categories, namely indictable and non-indictable offences. Indictable offences are more serious offences and they are usually dealt with by the District Court, although in some instances they may also be dealt with in the Magistrates Courts. Non-indictable offences are less serious criminal offences, which are usually dealt with in the Magistrates Court.

Just because you have been charged with a criminal offence it does not mean that you are guilty of same. Under the current law, the prosecution has to prove beyond a reasonable doubt that you are guilty of the offence, failing which you will be found not guilty. In some instances, we may be able either reduce your charges or to completely have them withdrawn even before the matter goes to a trial. In the past our solicitors have been successful in reducing serious charges to less serious charges, which helped our client’s avoid jail terms.

If you have been charged with a criminal offence please contact our office to arrange an appointment with one of our lawyers specialising in the area of criminal law. We will be able in most instances to provide you with accurate legal advice regarding your prospects in defending charges against you, even before the brief of evidence has been provided to us by the prosecutor.

Whether you want to plead guilty or not we will be able to assist you regarding your charges. Whether you are charged with serious traffic offence or a criminal offence it is very important that you seek a professional advice immediately. NQ Legal has experienced criminal solicitors who can assist you in any criminal matter you may be involved in.

Please contact us to find out more or to discuss our fixed fees and disbursements.
