You have a right to have a solicitor present during questioning and not to give statements until you have been provided with a legal advice. In most instances you may be within your rights not to give statements at all.
Criminal charges are usually divided in two major categories, namely indictable and non-indictable offences. Indictable offences are more serious offences and they are usually dealt with by the District Court, although in some instances they may also be dealt with in the Magistrates Courts. Non-indictable offences are less serious criminal offences, which are usually dealt with in the Magistrates Court.

Under the current law, the prosecution has to prove beyond a reasonable doubt that you are guilty of the offence, failing which you will be found not guilty.
